A New York State Law that went into effect on June 1, 2008 required online retail outlets such as Amazon.com, and NewEgg.com to collect sales tax from New York State customers even though their businesses were based out of state. Amazon filed a counter lawsuit not question whether or not charging a sales tax from the internet was legal, but whether it was legal for New York to regulate another business that operates in another state.

NewEgg.com after abiding by the law for a few months has decided to stop collecting the sales tax stating that “After careful review and consideration, we are pleased to inform you that we have stopped collecting New York sales tax, effective August 21, 2008. This decision was driven by your direct and candid feedback and our continued commitment to you as our valued customers.” They still note that the NYS consumer may still be liable for taxes from their online purchases and that it is their responsibility to file appropriately.
